1. OVERVIEW

This website and online store are operated by NADELANA LTD, trading as Nobelune ("Nobelune," "we," "us," or "our"). NADELANA LTD is a company registered in England and Wales under company number 14543293, with its registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

These Terms of Service ("Terms") govern your access to and use of nobelune.com, including all related content, features, products, digital products and services (collectively, the "Services"). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

If you do not agree to these Terms, you should not access or use the Services.

2. ELIGIBILITY AND CUSTOMER INFORMATION

You must be at least the age of majority in your state, province or country of residence to place an order, or use the Services with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account. You are responsible for keeping your account credentials confidential and for activity carried out through your account. You may not sell, transfer or assign your account to another person.

3. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to describe and display our products accurately. However, colors and appearance may vary depending on your screen, device settings and lighting. Product packaging, minor details and specifications may also change when reasonably necessary, provided that the product remains materially consistent with its description.

Product availability is not guaranteed. We may limit quantities, discontinue products or restrict sales to particular locations when reasonably necessary. Nothing in these Terms limits any description, warranty or consumer right that cannot lawfully be excluded.

Digital products are supplied electronically and do not require physical shipping. The product page will identify when an item is digital.

4. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or begin fulfillment, whichever occurs first. We reserve the right to reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or inventory errors, delivery restrictions, or misuse of a promotion.

If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method.

Please review your products, variants, quantities, email address and delivery address before submitting your order. If you need to request a cancellation or address change, contact us as soon as possible. We cannot guarantee changes after processing has begun.

Products purchased through our store are intended for personal or household use and not for unauthorized commercial resale.

5. PRICES, PROMOTIONS AND PAYMENT

Prices are displayed in the currency shown on the store and may change without notice. The price charged is the price displayed when the order is submitted, subject to correction of an obvious error.

Discounts and promotions may have separate eligibility requirements, expiration dates or quantity conditions. Unless expressly stated otherwise, promotions cannot be combined. If a pricing or promotional error is discovered, we may contact you for instructions or cancel and refund the affected order.

Shipping charges and applicable taxes, if any, are displayed before completion of checkout. You authorize us and our payment providers to charge the payment method supplied for the total shown at checkout. You confirm that you are authorized to use that payment method.

6. SHIPPING AND DELIVERY

Processing and delivery times are estimates, not guarantees, and may be affected by carriers, severe weather, high-volume periods, customs or events outside our reasonable control. We remain responsible for fulfilling the order in accordance with applicable law.

If we cannot ship within the timeframe stated at the time of purchase, we will contact you with a revised estimate and give you the option to accept the delay or cancel the unshipped order for a full refund. If we are unable to obtain any consent required by applicable law, we will cancel and refund the unshipped order.

You are responsible for providing a complete and accurate delivery address. Subject to applicable law, title and risk of loss pass to you when the order is delivered to the address supplied at checkout.

7. RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations, replacements and refunds are governed by our Refund Policy:

The Refund Policy forms part of these Terms. Nothing in these Terms or the Refund Policy limits rights that cannot be excluded under applicable consumer law.

8. DIGITAL PRODUCTS

Digital products are delivered electronically to the email address used at checkout after payment is confirmed. You are responsible for entering a valid email address and maintaining compatible software and devices needed to access the files.

Your purchase grants you a limited, personal, non-exclusive, non-transferable license to use the digital product for its stated purpose. Unless the product page expressly permits it, you may not resell, redistribute, sublicense, publicly share or commercially reproduce a digital product.

Digital products that have been accessed or downloaded are non-returnable and non-refundable except where required by law or where the file is defective, inaccessible or materially different from its description. Additional details appear in our Refund Policy.

9. INTELLECTUAL PROPERTY

The Services and their original content, branding, design, text, graphics, logos and other materials are owned by us or used under license and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, publish, scrape, sell or commercially exploit protected materials from the Services without permission from the applicable rights holder.

Nobelune names, logos and branding may not be used without our prior written permission. Shopify names and logos are trademarks of Shopify or its affiliates. Other names and marks belong to their respective owners.

10. THIRD-PARTY SERVICES AND LINKS

The Services may include tools, payment services, applications or links supplied by third parties. Those services may be governed by separate terms and privacy policies. We are not responsible for third-party websites or services that we do not control.

Before completing a transaction with a third party, you should review its applicable terms and policies. Concerns about a third party's own services should be directed to that third party.

11. RELATIONSHIP WITH SHOPIFY

Nobelune is powered by Shopify, which provides the ecommerce platform used to offer the Services. Purchases made through this store are transactions directly between you and NADELANA LTD trading as Nobelune. Shopify is not the seller of our products and is not responsible for fulfillment, returns, product claims or customer service relating to your Nobelune purchase, except to the extent required by applicable law.

You represent that your Feedback reflects your genuine experience, that you have the rights needed to submit it, and that you have disclosed any material incentive or compensation connected with it. Feedback must not be false, misleading, defamatory, unlawful, abusive, obscene, infringing or harmful.

We may moderate or remove Feedback that violates these Terms or applicable law. We are not required to publish every submission, compensate you for Feedback or treat Feedback as confidential.

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping charges, delivery estimates or availability. We may correct such information and, where necessary, contact you, cancel an affected order and issue a refund.

We do not guarantee that the Services will always be uninterrupted, secure or error-free. We may suspend or modify parts of the Services for maintenance, security or operational reasons.

16. WARRANTIES AND CONSUMER RIGHTS

To the fullest extent permitted by law, the Services are provided on an "as available" basis. We do not make warranties beyond those expressly stated in these Terms, on the relevant product page or required by law.

Nothing in these Terms excludes, restricts or modifies any statutory warranty, guarantee or consumer right that cannot lawfully be excluded. The exclusions in this section do not apply where prohibited by applicable law.

17. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive or consequential losses, or for lost profits, revenue, savings, business opportunity or data, arising from use of the Services or products purchased through them.

Where liability may lawfully be limited, our aggregate liability relating to a particular order will not exceed the amount you paid for that order. This limitation does not affect any mandatory consumer remedy.

18. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless NADELANA LTD, Nobelune and their officers, employees, contractors and service providers from third-party claims, losses and reasonable costs arising directly from your unlawful use of the Services, your material breach of these Terms or your infringement of another person's rights.

This section does not require a consumer to indemnify us for our own breach, negligence or unlawful conduct.

19. TERMINATION

You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary to protect the Services, comply with law, prevent fraud or address a material violation of these Terms.

Termination does not affect rights or obligations that arose before termination. Provisions that by their nature should survive—including intellectual property, payment obligations, disclaimers, limitations of liability and governing law—will continue to apply.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of England and Wales, without depriving you of mandatory consumer protections that apply in your place of residence.

The courts of England and Wales will have jurisdiction over disputes arising from these Terms, except where applicable consumer law gives you the right to bring or defend proceedings in another court.

21. SEVERABILITY, WAIVER AND ASSIGNMENT

Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, sale of assets or transfer of the business, subject to applicable law.

These Terms, together with the policies referenced in them, constitute the agreement between you and us concerning the Services.

22. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our Services, business practices or legal obligations. The current version will be posted on this page with a revised "Last updated" date. Where required by law, we will provide additional notice of material changes.

Changes apply from the stated effective date and do not retroactively reduce rights relating to orders already accepted.
